If you do not agree to these Terms, you may not use the Service. If you are using LuminStudy on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
You must be at least 13 years old to use LuminStudy. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service. We reserve the right to verify your age and eligibility at any time. If you do not meet these requirements, you may not use LuminStudy.
To use LuminStudy, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately of any unauthorized access or use of your account. We are not liable for any loss or damage arising from unauthorized account access.
We reserve the right to suspend or terminate your account at any time, with or without cause, including for violation of these Terms or misuse of the Service.
You retain all ownership rights to any study materials, notes, text, or other content you upload to LuminStudy. By uploading User Content, you grant LuminStudy a worldwide, non-exclusive, royalty-free license to store, process, and display your content for the purpose of providing the Service.
All tests, summaries, flashcards, mind maps, podcasts, and other content generated by LuminStudy's AI tools are owned by you. You may use, modify, share, or delete Generated Content as you see fit. LuminStudy retains the right to use anonymized, aggregated data about Generated Content to improve the Service.
You agree not to upload, create, or share content that is illegal, harmful, plagiarized, discriminatory, sexually explicit, or malicious. We reserve the right to remove prohibited content and suspend or terminate your account.
You agree to use LuminStudy only for lawful purposes and in compliance with these Terms. You agree not to:

LuminStudy offers free and paid subscription plans. Pricing is displayed at the time of purchase and may change with 30 days' notice.
Paid subscriptions are billed monthly or annually, depending on your chosen plan. Billing occurs automatically on the date you subscribe and on each renewal date thereafter. You authorize us to charge your payment method on file.
Refunds are not available for subscription fees. However, if you cancel your subscription before the next billing date, you will not be charged for the next billing cycle. Cancellation does not entitle you to a refund of fees already paid.
You may cancel your subscription at any time through your account settings. Cancellation takes effect immediately, and you will retain access to paid features until the end of your current billing period.
LuminStudy stores your User Content and account information indefinitely, unless you request deletion. Your data is retained to provide the Service and improve our AI models using anonymized, aggregated data only.
We implement industry-standard security measures to protect your data. However, no security system is impenetrable, and we cannot guarantee absolute security.
You may request deletion of your account and associated User Content at any time. We will delete your account within 30 days of your request. We may retain anonymized, aggregated data for analytics and service improvement.

LUMINSTUDY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not guarantee that Generated Content will be accurate, complete, or suitable for your needs. Using LuminStudy will not guarantee improved academic performance or exam scores.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMINSTUDY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING LOST PROFITS, LOST DATA, OR LOST OPPORTUNITIES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO LUMINSTUDY IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless LuminStudy, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your User Content, or your infringement of third-party rights.
LuminStudy may integrate with or link to third-party services. We are not responsible for the content, accuracy, or practices of third-party services. Your use of third-party services is governed by their terms and privacy policies.
We reserve the right to modify, suspend, or discontinue LuminStudy or any feature at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.
We may update these Terms at any time. Changes become effective upon posting to the Service. Your continued use of LuminStudy following any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
These Terms are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.
You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Australia, and you consent to the jurisdiction and venue of such courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if such modification is not possible, the provision shall be severed. These Terms, together with our Privacy Policy, constitute the entire agreement between you and LuminStudy regarding your use of the Service and supersede all prior and contemporaneous agreements, understandings, and negotiations.
